DWI Penalties For Offenses as of Jan 20, 2004 N.J.S.A. 39:4-50(a)
- First offense: 0.08% or more, but less than 0.10% (per se) or under the influence of intoxicating liquor (observation)
- Fine: $250-$400
- IDRC: 12-48 hours
- Jail: Up to 30 days
- Loss of Drivers License: 3 months
- Interlock (39:4-50.17): Optional 6 months to 1 year commencing immediately after the suspension period.
- First offense: 0.10% or higher (per se) or under the influence of drugs (observation)
- Fine: $300-$500
- IDRC: 12-48 hours
- Jail: Up to 30 days
- Loss of Drivers License: 7 months to 1 year
- Interlock (39:4-50.17): Optional 6 months to 1 year commencing immediately after the suspension period.
- Second offense: 0.08% or higher under the influence of intoxicating liquor or drugs (observation)
- Fine: $500-$1,000
- IDRC: 48 hours (in lieu of 2 day jail requirement)
- Jail: 2-90 days
- Loss of Drivers License: 2 years
- Interlock (39:4-50.17): 1-3 years after the suspension period or 2 years Registration suspension (39:3-40.1):
- Third offense: 0.08% or higher under the influence of intoxicating liquor or drugs (observation)
- Fine: $1,000
- Jail: 180 days (up to 90 days can be served through inpatient program approved by IDRC. Note: Jail cannot be served through IDRC, Community Service or Work Release (SLAP)
- Loss of Drivers License: 10 years
- Interlock (39:4-50.17): 1-3 years after the suspension period or 10 years Registration suspension (39:3-40.1)
