EBM Law’s Guide to the New Jersey State Police’s New Expungement Order Guidelines

On March 19, 2025, the Office of the Public Defender for the State of New Jersey announced new guidelines the State Police will follow for processing criminal expungement orders under the terms of a settlement agreement. The new guidelines are meant to expedite and increase transparency in the criminal expungement process in New Jersey. Due to COVID-19 related backlog, individuals granted expungements from their criminal records have been faced with wait times of several years, with limited information regarding the status of their expungement orders being made available. New Guidelines:
Effective on June 1, 2025, the New Jersey State Police will adhere to the following new guidelines for processing criminal expungements orders:
For new and existing orders, the NJSP will remove all expunged records from an individual’s criminal case history (CCH) within 120 days of receipt, unless the order requires additional information or amendments for processing.- If additional information is required, the NJSP will notify the individual or their attorney within 120 days, ensuring to process the order within 15 days of receiving the required information or else within 45 days of receiving the amended order from the Judiciary.
- If a judge orders a unique time frame for criminal expungement processing, the NJSP will “make every effort to comply”.
- Individuals granted criminal expungements will be able to view the status of their orders through a new online portal, available at https://expungement.njsp.gov/.
